Welcome to Floodlight for B2B (“Service”). By accessing or using our Service, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

1. Acceptance of Terms

By using our Service, you agree to comply with and be bound by these Terms, including our Privacy Policy. If you do not agree to these Terms, you may not access or use our Service.

2. Service Description

Floodlight for B2B allows users to detect and qualify company leads from anonymous B2B visitors on their digital touchpoints. The Service is available through different subscription plans, as outlined below.

3. Account Registration

To access the Service, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account and are liable for all activities under your account.

4. Subscription Plans and Payment

A. Current Subscription Plans:

    * Free Plan: Access to the Floodlight for B2B Mautic plugin, limited to public DNS/Whois data, without access to the Floodlight for B2B API.

    * PRO Plan: Includes 5,000 Floodlight for B2B API calls per month, with additional data access beyond the Free Plan.

    * PRO Recharge: Users may purchase additional API call quotas beyond the PRO Plan, available in increments of 5,000, 10,000, or 25,000 API calls per month.

B. Usage Limits and Overages:

    * Usage Warnings: Users approaching their monthly API call limit will receive a warning in the Mautic interface and via email.

    * Exceeded Usage: Upon reaching the API call limit, access to the PRO Plan features will be temporarily disabled, and the Service will revert to Free tier functionality, which includes access to public DNS/Whois data only. Additional API calls can be restored by purchasing a PRO Recharge package.

C. Billing: Subscription fees are billed on a [monthly/annual] basis, as specified during signup. All fees are non-refundable.

D. Cancellation and Refund Policy:

    * Cancellation: Users may cancel their subscription at any time before the next auto-renewal date. Cancellation can be done through account settings or by contacting support.

    * No Refunds: All payments for subscriptions are final, and no refunds will be issued for cancellations made mid-billing cycle. Upon cancellation, access to PRO Plan features will remain active until the end of the current billing period.

5. Usage and Limitations

A. Permitted Use: You may use the Service solely in accordance with these Terms and applicable laws.

B. Usage Limits: Access to the Service is subject to usage limits as defined in your subscription plan.

C. Restrictions: No specific usage restrictions apply beyond those outlined in the subscription plan. Users are expected to use the Service in compliance with all applicable laws and regulations.

6. Data Privacy

Our API does not collect any personal data. The data provided through the Floodlight for B2B API is strictly limited to company-related information, including public DNS, Whois, business attributes, technology details, and publicly available contact data. 7. Support and Service Level Agreement (SLA)

The Floodlight for B2B API is provided on a best-effort basis. While we strive to maintain continuous service and respond promptly to support inquiries, no specific uptime or response time guarantees are provided. For assistance, users may reach out via [support contact method].

8. Intellectual Property

All intellectual property rights in the Service and its content are owned by Leuchtfeuer Digital Marketing GmbH. You are granted a limited, non-exclusive, non-transferable license to use the Service solely in accordance with these Terms.

9. Termination

We reserve the right to suspend or terminate your access to the Service if you violate these Terms or if your account remains inactive for an extended period. Upon termination, you must cease all use of the Service.

10. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

In no event will Leuchtfeuer Digital Marketing GmbH be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Service, even if we have been advised of the possibility of such damages.

12. Governing Law and Jurisdiction

These Terms of Service and any disputes arising from or related to the Service shall be governed by the laws of Germany, with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. Legal disputes will be handled exclusively in the courts of Hannover, Germany.

13. Modifications to Terms

While updates to these Terms of Service are not anticipated frequently, we reserve the right to make changes as needed. In the event of significant changes, we will notify users via email. Continued use of the Service after updates constitutes acceptance of the modified Terms.
